  • MiCAR CASP:加密资产托管与管理、运营交易平台、加密资产与资金/其他加密资产兑换、执行订单、配售、接收和传递订单、提供加密资产建议、投资组合管理、转账服务等。
  • EMI:发行和赎回电子货币,并可提供支付账户、转账、汇款、支付交易、现金存取等支付服务。
  • CASP 与 EMI 可分别服务不同业务目的:CASP 解决加密资产服务授权,EMI 解决电子货币、支付账户和欧盟支付通道能力。
  • 如涉及稳定币、ART/EMT、交易平台或托管,应同步评估 MiCAR issuer / CASP obligations、资金流和客户资产保护。
  • MiCAR CASP: custody and administration of crypto-assets, operation of a trading platform, exchange of crypto-assets for funds or other crypto-assets, execution of orders, placing, reception and transmission of orders, advice, portfolio management and transfer services.
  • EMI: issuance and redemption of electronic money, and payment services such as payment accounts, transfers, remittance, payment transactions and cash deposits/withdrawals.
  • CASP and EMI serve different purposes. CASP covers crypto-asset services, while EMI covers e-money, payment accounts and EU payment channel capability.
  • If stablecoins, ART/EMT, trading platforms or custody are involved, MiCAR issuer and CASP obligations, fund flow and client asset protection should be assessed together.
