- CASP route is based on Regulation (EU) 2023/1114 on Markets in Crypto-Assets (MiCAR). The Bank of Lithuania has started granting crypto-asset service provider authorisations under MiCAR.
- EMI route is based on the Lithuanian electronic money institution framework. An unrestricted EMI licence can be passported across the EU, while a restricted EMI is limited to Lithuania and subject to scale limits.

- MiCAR CASP:加密资产托管与管理、运营交易平台、加密资产与资金/其他加密资产兑换、执行订单、配售、接收和传递订单、提供加密资产建议、投资组合管理、转账服务等。
- EMI:发行和赎回电子货币,并可提供支付账户、转账、汇款、支付交易、现金存取等支付服务。
- CASP 与 EMI 可分别服务不同业务目的:CASP 解决加密资产服务授权,EMI 解决电子货币、支付账户和欧盟支付通道能力。
- 如涉及稳定币、ART/EMT、交易平台或托管,应同步评估 MiCAR issuer / CASP obligations、资金流和客户资产保护。
- MiCAR CASP: custody and administration of crypto-assets, operation of a trading platform, exchange of crypto-assets for funds or other crypto-assets, execution of orders, placing, reception and transmission of orders, advice, portfolio management and transfer services.
- EMI: issuance and redemption of electronic money, and payment services such as payment accounts, transfers, remittance, payment transactions and cash deposits/withdrawals.
- CASP and EMI serve different purposes. CASP covers crypto-asset services, while EMI covers e-money, payment accounts and EU payment channel capability.
- If stablecoins, ART/EMT, trading platforms or custody are involved, MiCAR issuer and CASP obligations, fund flow and client asset protection should be assessed together.

资本要求Capital Requirements
- MiCAR Article 67 下 CASP 初始资本按服务类别分级:Class 1 为 EUR 50,000,Class 2 为 EUR 125,000,Class 3 为 EUR 150,000;最终还需满足自有资金/固定开支等审慎要求。
- Unrestricted EMI 通常需 EUR 350,000 初始资本,并持续满足自有资金与客户资金 safeguarding 要求。

- Under MiCAR Article 67, CASP initial capital is tiered by service class: Class 1 EUR 50,000, Class 2 EUR 125,000 and Class 3 EUR 150,000. Own funds and fixed overhead requirements also apply.
- Unrestricted EMI generally requires EUR 350,000 initial capital and ongoing own funds and customer funds safeguarding.
- Restricted EMI is not subject to a minimum initial capital requirement, but business is limited to Lithuania and subject to average outstanding e-money/payment transaction thresholds.
- If the business involves both CASP and EMI, capital, client assets, customer funds, on-chain assets, fiat channels and operating expenses should be modelled together.

- If applying for both CASP and EMI, the applications should be phased to avoid conflicts in fund flow, client assets and regulatory perimeter.
